Do You Really Need a Lawyer for Your Divorce?
If you are thinking about divorce, one of the first questions you're likely asking is: Do I really need a lawyer? With so many online tools and DIY options available today, it is easy to assume you can navigate the process yourself—especially if things seem civil between you and your spouse.
However, the reality is that divorce is a legal process, and even seemingly simple cases can quickly get complicated. This is especially true when your emotions are so involved with your children, finances and your uncertain future. At Carbone Law Firm, we have been guiding clients through Massachusetts family law for over twenty-four years—and we have seen firsthand how the right legal representation can make all the difference.
When You Might Not Need a Lawyer
There are a few, rare situations where going without an attorney might work:
Your divorce is completely uncontested. This means that you and your spouse agree on absolutely everything.
You do not have children together.
You own little or no shared property or debt.
In these cases, you might consider working with a mediator or using Massachusetts’ approved divorce forms. But proceed with caution—small mistakes can lead to big consequences. Always remember that while you and your spouse may agree on the terms of your divorce, a judge must sign off on your Agreement. While there are a variety of reasons judges reject settlements, the most common revolve around children. Some examples are
The child support is not properly calculated in adherence to the Massachusetts Child Support Guidelines.
The parties claiming they have “joint” physical custody, but then drafting a parenting plan that favors one parent over the other.
Not properly identifying the educational, extracurricular or other like costs over and above child support.
In a nut-shell, even when you agree, there are still pit-falls involved in these cases where having an attorney can be a benefit.
When You Definitely Should Hire a Lawyer
In Massachusetts, divorce law can be complex—and what is fair is not always obvious. You should absolutely speak to an attorney if:
Children are involved. Child custody, parenting time, and support are too important to risk.
There are shared assets or debts. Whether there is a house, investments, or credit card balances, proper division matters.
You or your spouse owns a business. Oftentimes a spouse with their own business will claim that without them, their business is “worthless.” This is not how the courts view this issue. Having an attorney who can evaluate a business is critical.
Retirement accounts. These require careful valuation and negotiation.
There is any history of abuse, control, or intimidation.
Your spouse already has legal representation.
Having your own lawyer ensures your interests aren’t overlooked or compromised.
